In their Memorandum Opinion pertinent to my winning Appeal # 28843,on June 19, 2009 the Intermediate Court of Appeals stated:
“Before the children’s relocation to Hawai’i pursuant to the 1999 stipulated custody order, Mother had been the primary caretaker for the children. Even after the children’s relocation, Mother enjoyed liberal time-sharing rights. By prohibiting all contact between Mother and her children, the November 2000 Ex Parte Orders effected a draconian change in the custodial arrangements. Yet, the family court permitted the November 2000 Ex Parte Orders to stand without ruling on the validity of the allegations on which the orders were based or the continued necessity for the orders.”

My ex-husband, Kevin Chee (a Honolulu attorney with Chee and Markham) manipulated the family court's draconian change of custody. During my parenting time in Michigan, our 9 year old daughter was violently taken away from me by GAL Kim Towler. Our little girl struggled so hard, Towler was injured during our daughter's efforts to resist being dragged out of her elementary school. She tried to jump out of Towler's car as it sped away on the interstate freeway.

Armed with the Ex-Parte change of custody, GAL Kim Towler, my ex-husband and his secretary Cyd Ignacio, had traveled together to Michigan to "get" our daughter. Judge Suemori's orders specified that no notice be given to me OR my counsel. The night before the snatching, GAL Towler slept in the same Hampton Inn hotel room with Cyd Ignacio, my ex husband's secretary. (Aren't GAL's supposed to be neutral?) After driving 48 straight hours to the West Coast, Towler forced our daughter onto a plane bound for Hawaii.

Upon arrival in Hawaii, psychologist Marvin Acklin executed the pre-travel plan and admitted our daughter into the locked psychiatric ward of Kahi Mohala. Given the draconian change of custody and resulting physical and mental abuse sustained by our daughter, Acklin's role, like GAL Towler's, was the equivalent of severe child abuse. Although up until that point I had been our daughter's primary caregiver, Acklin refused to allow our daughter to have any contact with her mother. After 3 years I finally had 2 hours visitation with our daughter. I called Acklin to pleed for normalized family contact. He referred to my ex-husband's family law attorneys, GAL Towler and himself as "Players" and emphasized I would have to "play" by their rules (supervised visitation).

There is a daisy chain of interwoven relationships between family law attorneys, GAL's and psychological therapists. These "Players" are motivated by money, power and relationships. Those of us, parents and children, who have been blindsided by their actions have suffered profound human indignities. Legislative actions to prevent physical, mental, and financial abuse to family court customers are needed urgently.

It is time for family court transparency because these daisy chain "Player" family court abuses are ongoing. Marvin Acklin and GAL Towler have a toxic sense of power. Children suffer. I hope family court abuse, like what happened to me and our daughter, can be prevented. Public exposure to these injustices may generate much needed sunshine and accountability.

Hi Melinda,

Once again, we have another 'professional' in common. Dr. Marvin Acklin became apart of my divorce proceedings through our attorney in common,
Durell Douthit.

The same psychologist who Douthit insisted I see in order to be "more centered" and to "stop skipping from subject to subject". This while, simultaneously, disregarding and never advocating for my desire that my traumatized daughter see child psychologist, Rebbecca Padua. (A wonderful woman who my daughter eventually had therapy with after I pushed the issue for over a year and who was ultimately the ONLY legit professional involved in these same proceedings that Judge Darryl Choy suddenly dismissed 23 months down the line).

The same psychologist who I saw for a few months back in 2000. The same psychologist who didn't ever talk about any custody issues in any of the sessions I had with him then. The same psychologist who somehow misplaced my records when I requested them back in the year 2006. The same psychologist who claimed that 2000 was "a long time ago" and ended up sending me a few papers on which he had scribbled comments like hot-headed, distored, out there, a screamer and other similar things refering to my behavior during our visits. (BTW; does anyone know how long a doctor is required to hold onto a patients records?)

The same man who is also a documented abuser.

The same court appointed evaluator/psychologist who, according to an article published on the internet, was arrested for choking his wife a few years back. (Sorry, I don't have the link at the moment...goggle his name and you're sure to find it)

And, what was the punishment doled out by the Hawaii Family Court to one of their own?

A $25 dollar fine and Acklin ordered into therapy.

The same psychologist who still works for this same family court as an expert till today. On the other hand, the same court which, without any proof whatsoever, determined that I was an abuser and then fired me from my job as a mother to my daughter in a matter of moments on 4/7/05.

THIS IS THE TWISTED MINDS THAT WE HAVE TO BE SUBJECTED TO ALL BECAUSE WE DECIDED TO LEGALLY MARRY AND HAVE CHILDREN.

What we are dealing with here is in no way a court in any sense but rather an organized crime ring unlike any other.

Because, these criminals have a multitude of benefits that the mafia never will. Like being apart of one of the only allowed monopolies in the USA. Like being protected with immunity for any actions they take as a party to a case. Like being literally above the law and receiving a slap on the wrist after doing something that some people would be sent to prison for.

I still can't get over this abomination.


Yet, as sick as all this makes me, everyday, I am so grateful for this site where all of us who have been violated by these same 'professionals' can connect the dots and finally make sense of senselessness. Where we will expose them for what they really are and be apart of finally shutting them down for good. Then this horrific experience will all be worth it.

I only live to see my daughter's beautiful face again and for this miracle to happen in the State of Hawaii.

Marvin Acklin, Ph.D.

Marvin Acklin, Ph.D. was arrested and charged in 1990 with a domestic violence assault on his wife, Denise Acklin, after he violently choked her. He pled guilty in First Circuit Court, paid a $25 fine, and this psychologist was sentenced to "therapy." In 1995, he asked his record be wiped clean for good behavior and the court agreed.

Since, Acklin has been in court many times testifying as an "expert" in everything from family custody cases to guardianship matters to murders, including those committed by Byran Uyesugi, as he’d been the psychologist who assessed him before he was sent back to work.

The background on the case: In November 1999, Byran Uyesugi, who was employed by Xerox Corp. for 15 years, entered the main office headquarters on Nimitz Highway at 8 a.m. and shot and killed seven innocent co-workers.

Prior to this, Uyesugi displayed violent tendencies while performing a service call at First Hawaiian Bank, resulting in criminal charges being filed against him. He had violently kicked in an elevator door at First Hawaiian and threatened the lives of his co-workers.

Uyesugi was sent to Castle Medical Center for five days, where he was tested by Acklin and another doctor, but he was released despite what several civil lawsuits filed against him since the murders consider poor judgement. "Despite strong evidence that Uyesugi was suffering from a serious mental illness, the defendants (Acklin) released him after only five days of observation and treatment … Acklin was negligent in that, among other things, no adequate disclosure of Uyesugi’s condition was made, nor was adequate warning given regarding the severity of Uyesugi’s mental illness and/or his foreseeable dangerousness to others…"

A lawyer representing many of the plaintiffs in a lawsuit against Acklin, set for trial in March 2005, says she is charging that Acklin made several assessments of Uyesugi outside of his professional scope of knowledge and capabilities. As a result, other doctors took him at his word, and did not dig further into Uyesugi’s mental illness, thereby possibly preventing Uyesugi from committing the murders. Acklin, of course, is disputing those claims against him......(read more at link below)

Where does one start to begin to describe the disgust that the very name Marvin Acklin brings?????

"Dr." Acklin began meeting with my ex-husband and his attorney months before my ex-husband took me to court on the bogus, beloved allegation of Parental Alienation. This was not revealed to me until it was too late.

Dr. Acklin met with me for just a mere two hours before deciding that I was so dangerous to my children that I could not and should not see them for almost 2 years.

He never saw me with my children.

He never talked to me about anything more than a previous court/CPS case where my ex-husband had been investigated for abuse.

He put absurd lies in a report to the court.

He completely misquoted me and showed his own bias against me to my face for my being a Christian.

He wrote in his report that my daughter told him that her father does things to her that make her not want to be with him, yet the good "doctor" testified that he never even asked my daughter what she meant by that statement.

Dr. Acklin was to ensure that my children saw a therapist for this so-called psychological damage that I did to them. He hid behind the family court's delays and said without a court order he wasn't sure what he should do (though he was the very one recommending that the court DO it). He finally got his good friend, Dr. Sue Lehrke (another follower of the PAS bologna) to see my children all of SIX times. That's it. After saying that it would take YEARS to "unscrew" my kids, six sessions is all it took.

I have e-mails that were submitted at trial that are from our good Dr. Acklin to my ex-husband. (My ex-husband's attorney submitted as evidence) The e-mails are horrible. Dr. Acklin bashes me and says such unprofessional things in them about me. He even tells my ex-husband to start recording my phone calls without my knowledge in order to entrap me!!!! This was all brought out at trial. Dr. Acklin, amazed that he was having to testify to his own misdeeds, only stated that he was not aware that this was ILLEGAL! Amazing! The judge did nothing to admonish his behavior and on he went to testify in other cases, just like mine.

Dr. Acklin is certainly part of the problem in Hawaii's courts. He is a player and benefactor of the corruption that has overcome the courts in such a beautiful place. I have even been contacted by another lady who says she is using Dr. Acklin's services to her own benefit. Disgust overcomes me when I even consider this man is considered an expert at anything other than deception.

I'd like to offer a follow-up to my posting about Dr. Acklin.

Dr. Acklin was asked to give a deposition recently regarding his actions in my case. In this latest deposition, he claimed to not EVER make custody recommendations to the court. He completely reversed all statements he had previously made in my case. All statements are part of the record and the withdrawal of those previous recommendations only proves Dr. Acklin's unethical practices.

There has also been a peer review of Dr. Acklin's work in my case. Let me share with you a quote from this report regarding Dr. Acklin's involvement... "There are so many minor and major problems with this evaluation that a very lengthy report could cover just the ethical concerns about this forensic evaluation."
